Form 35 & 36.

Form 35 is used for filing an appeal before the Commissioner of Income Tax (Appeals) and Form 36 is used for filing an appeal before the Income Tax Appellate Tribunal. What is Form 35?

What is Form-36?

​Form 36 is used for filing an appeal before the Income Tax Appellate Tribunal.

Who is CIT(A)?

​​​​The CIT(A) is the first appellate authority for an assessee aggrieved by the assessment order passed against him / her.

Who is ITAT?

ITAT is nothing but Income Tax Appellate Tribunal. You can file appeal with ITAT against the orders of CIT(A).

What is the due date to file appeal?

The Form 35 can be filed with in 30 days from the receipt of the order and the Form 36 can be filed with in 60 days form the communication of the order.

What if we don't file Form 35 & 36?

You need to accept the order passed by the assessing officer.

What is the fee for filing Form 35 & 36?

It depends on the returned income. For the returned income of Rs. 1 laksh the filing fee for Form 35 is Rs. 250/- and for Form 36 is Rs. 500/-.
